Email Communications. Customer consents to receive all communications from GrowNYC Wholesale via email, including but not limited to product availability lists, order confirmations, invoices, delivery notifications, and notices regarding changes to these terms. Customer is responsible for ensuring that the email address(es) provided to GrowNYC Wholesale are current and monitored regularly.

Formal Notices. Any formal notice required under this Agreement (including notices of termination, claims, or disputes) shall be in writing and shall be deemed delivered when: (a) delivered personally, (b) sent by confirmed email at the email address provided by Customer or GrowNYC as the case may be, (c) delivered by overnight courier service, or (d) three business days after being sent by certified or registered mail, postage prepaid, return receipt requested, to the addresses specified in Customer’s account information or to GrowNYC Wholesale at:

Customer’s Obligation to Update Information. Customer shall promptly notify GrowNYC Wholesale in writing of any changes to contact information, business structure or affiliation, ownership, or financial condition that may affect this Agreement.

Electronic Records. Customer agrees that electronic records of orders, invoices, and communications shall constitute valid business records and may be used as evidence in any dispute.
